1. Acceptance of Terms

By accessing our website, placing an order, or using any service offered by Mahakal Online Food (operated by AK Infra), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legally binding agreement between you ("Customer") and AK Infra ("Company", "we", "us").

2. About the Company

Mahakal Online Food is a cloud kitchen and food delivery service operated by AK Infra, registered at Ground Floor G-01, SK Plaza, Kavi Nagar, Delhi Road, Ghaziabad – 201002, Uttar Pradesh, India. We prepare and deliver food items to customers in Ghaziabad and surrounding areas.

3. Use of Our Services

You may use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Place false, fraudulent, or abusive orders.
  • Provide inaccurate delivery details leading to failed delivery.
  • Use our services to engage in any illegal activity.
  • Attempt to reverse-engineer, copy, or misuse any content from our website.
  • Harass, abuse, or threaten our staff, delivery partners, or representatives.
  • Submit false reviews or misleading complaints.

We reserve the right to refuse service to anyone who violates these terms.

4. Placing an Order

Orders can be placed via phone call, WhatsApp, or through our website's contact form. By placing an order, you confirm that:

  • You are at least 18 years of age, or are placing the order under parental or guardian supervision.
  • All information provided (name, address, contact number) is accurate and up to date.
  • You are authorised to use the payment method selected.
  • You understand and accept that food orders are subject to availability and kitchen capacity.

We reserve the right to reject or cancel any order at our discretion, especially in cases of inaccurate information, suspected fraud, or items that are unavailable.

5. Pricing and Payment

All prices displayed on our website and menu are in Indian Rupees (INR) and include applicable GST unless stated otherwise. Prices are subject to change without prior notice.

  • We accept Cash on Delivery (COD), UPI, Google Pay, PhonePe, and Paytm.
  • For catering and bulk orders, a minimum advance of 30% of the total order value is required at the time of booking.
  • Any applicable delivery charges will be communicated at the time of order confirmation.
  • We do not store or process card payment information on our servers.

6. Delivery

We strive to deliver your order within the estimated time frame of 30–45 minutes for standard home delivery. However, delivery times are approximate and may vary due to:

  • High order volumes or peak hours.
  • Adverse weather or traffic conditions.
  • Incorrect or incomplete delivery addresses.
  • Factors beyond our reasonable control.

We currently deliver within designated areas of Ghaziabad. Delivery availability is subject to our coverage zone. We reserve the right to modify our delivery area at any time.

If delivery is not possible due to circumstances beyond our control (e.g., inaccessible location, no recipient present after two attempts), the order may be cancelled and a partial refund may be processed after deducting preparation and delivery costs.

7. Food Quality and Allergens

We take food quality and hygiene seriously. Our kitchen follows FSSAI-compliant food safety practices. However:

  • Menu items are prepared in a shared kitchen and may contain traces of common allergens including nuts, dairy, gluten, eggs, and shellfish.
  • Customers with severe allergies must inform us at the time of ordering. We will make reasonable efforts to accommodate, but cannot guarantee a fully allergen-free meal.
  • Nutritional information, if provided, is approximate and may vary.
  • All images on our website are for illustrative purposes only. Actual dish presentation may vary.

8. Cancellation Policy

You may cancel your order within 10 minutes of placing it, provided cooking has not yet commenced. After this period, cancellations will be subject to our Refund Policy. We reserve the right to cancel orders due to:

  • Unavailability of the ordered item(s).
  • Inability to reach the customer for order confirmation.
  • Force majeure or extreme operational circumstances.

In such cases, a full refund will be processed if payment was made online.

9. Intellectual Property

All content on our website — including logos, text, images, graphics, and design — is the property of AK Infra and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any of our content without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, AK Infra and its owners, employees, and partners shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from the use of our services.
  • Loss of profits, data, or business arising from delivery delays or service unavailability.
  • Allergic reactions arising from undisclosed customer allergies or dietary conditions.
  • Damages caused by third-party payment or delivery platforms.

Our total liability to you for any claim arising from our services shall not exceed the amount paid by you for the specific order in question.

11. Indemnification

You agree to indemnify and hold harmless AK Infra, its officers, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India.

We encourage customers to first contact us directly to resolve any issue amicably before initiating legal proceedings.

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with the updated date. Your continued use of our services after any modification constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
